Victoria's sold price rule: 7 days, then 18 months online
Once a Victorian sale goes unconditional, the agent has 7 days to add the price to the Property Price Statement. It then stays online for 18 months.
In Victoria, a sale no longer ends at the sticker. The agent gets seven days from the day a sale goes unconditional to add the sale price to the Property Price Statement. Then the statement stays online, free, for at least 18 months.
Most of what's been written about the new law is about the reserve price. This article is about the other clock in the same Act. It starts after the sale.
This is Victorian law. It changes the Estate Agents Act 1980 (Vic). It doesn't apply in New South Wales or Queensland. They run their own rules.
What changed, and when
The Consumer Legislation Amendment Act 2026 (Vic) became law on 8 September 2026. It's No. 36 of 2026.
Section 2(2) of that Act starts the new agent rules on 1 October 2026. The sold price rules are in new sections 47AJ to 47AM of the Estate Agents Act.
The Property Price Statement replaces the statement of information. Consumer Affairs Victoria updated its page for agents on 8 September 2026. It says that under rules starting on 1 October 2026, "once a sale becomes unconditional, agents will need to publish the property's final sold price as part of the Property Price Statement".
The rules cover residential property only.
Seven days to add the sale price (section 47AJ)
Section 47AJ says the agent must add the sale price to the statement. The deadline is seven days after the unconditional sale date.
"The agent" covers more people than you'd think. The section applies to "an estate agent or agent's representative employed by the agent". So the salesperson on the sale is caught too.
The penalty is 240 penalty units. It's the same penalty the Act puts on running an auction without the reserve published for seven days.
There's one twist. If the Director of Consumer Affairs Victoria refuses an exemption, the deadline moves. It becomes seven days after the refusal, if that's later. More on exemptions below.
The clock starts on the unconditional date, not settlement
The Act defines the "unconditional sale date". It isn't settlement.
If the contract has no conditions, it's the day the contract is signed. A contract signed at an auction with no conditions goes unconditional that day. So a property sold on a Saturday needs its price on the statement by the next Saturday.
If the contract has conditions, like finance, it's the day the last condition comes off. The seven days start then.
18 months online, free (section 47AM)
Section 47AM says the agent must put the statement on a website within seven days of the unconditional sale date. It has to stay there, free for anyone to open, for at least 18 months.
The penalty is 240 penalty units.
The Act says "an Internet site". It doesn't say whose. A property that goes unconditional on 17 October 2026 has to keep its statement up until at least 17 April 2028. So work out now where your office's statements will sit for that long, and who puts the price on.
What happens to "price withheld"
There's no price withheld option on the statement. The sale price goes on unless the Director grants an exemption.
Under section 47AK, the vendor or the purchaser can apply to the Director for one. So can the agent, on their behalf. The application has to go in within seven days of the unconditional sale date, on the Director's form.
The listed reasons are family violence or personal violence involving the vendor or purchaser. The regulations can add other reasons. A vendor who'd simply like some privacy isn't on the list.
Section 47AL covers the wait. Until the Director has decided and said so in writing, the agent must not add the sale price. That's 240 penalty units too.
So the price conversation changes. If you've offered price withheld as a favour, it won't keep the price quiet any more. The price conversation with a vendor is a good place to rethink how you talk about the number from the first appointment.
The October grace period doesn't name these sections
You may have heard the new rules don't apply to auctions held up to 15 October 2026. That comes from new section 110.
Section 110 lists the rules that don't apply to an auction or fixed-date sale held within 14 days after 1 October 2026. It names the reserve price and advertising sections: 47AF, 47C, 47AG, 47AH and 47AI. It also keeps those sales on the old statement rules.
It doesn't name the sold price sections, 47AJ to 47AM. The Act doesn't settle how the sold price clock works for an auction held in that window. If you've got one, ask your principal.
What to do before your next listing
First, stop promising price withheld. Tell the vendor on the day they sign the authority. For an auction after 15 October, once it's unconditional, the price goes online within a week, and it stays up for at least 18 months. If family or personal violence means it can't go public, ask them to tell you privately. The application only has a seven-day window.
Second, at every signing, write day seven in the file. No conditions, it's seven days after the contract is signed. Conditions, it's seven days after the last one comes off. Name one person in the office who adds the price. If an exemption application has gone in, that person holds the price until you're told what the Director decided. What belongs in a property file covers the habit of writing the next date down.
Third, find out where your office's statements will live for 18 months, and who keeps them up.
None of this is legal advice. Read the Consumer Legislation Amendment Act 2026 (Vic). Read the Consumer Affairs Victoria page for agents. And ask your principal.
Frequently asked questions
When does Victoria's sold price rule start?
Section 2(2) of the Consumer Legislation Amendment Act 2026 starts it on 1 October 2026. Consumer Affairs Victoria's page gives the same date.
How long have I got to add the sale price to the statement?
Seven days after the unconditional sale date. If an exemption is refused, it's seven days after the refusal, if that's later.
Does the seven days start at settlement?
No. It starts on the unconditional sale date. With no conditions, that's the day the contract is signed. With conditions, it's the day the last one comes off.
How long does the statement have to stay online?
At least 18 months after the unconditional sale date. It has to be on a website, free for anyone to open.
Can a vendor still ask for price withheld?
Not on the statement. The only way to keep the price off is an exemption from the Director of Consumer Affairs Victoria. The listed reasons are family violence or personal violence involving the vendor or purchaser, plus any reason the regulations add. The application has to go in within seven days of the unconditional sale date.
Can I add the sale price while an exemption application is being decided?
No. Section 47AL says the agent must not add it until the Director has decided and given written notice.
Does the rule apply to private sales?
Yes. Sections 47AJ and 47AM cover residential property, not only auctions and fixed-date sales.
Are auctions held between 1 and 15 October 2026 caught?
The Act's 14-day grace period names the reserve price and advertising sections, not the sold price sections. It also keeps those sales on the old statement rules. The Act doesn't settle how the sold price clock applies to them. Ask your principal.
What's the penalty?
240 penalty units each, under sections 47AJ, 47AL and 47AM.
Does this apply in New South Wales or Queensland?
No. This is Victorian law, changing the Estate Agents Act 1980 (Vic). New South Wales and Queensland regulate agents under their own Acts.
